Terms & Conditions

These terms govern the supply of 3D CAD visualisation services by Garden Graphics 3D and the use of CAD Credits.

1. About us & these terms

These Terms and Conditions ("Terms") set out the basis on which Garden Graphics 3D ("we", "us", "our") supplies 3D CAD visualisation services to you, the customer ("you", "your"). By placing an order, purchasing CAD Credits or submitting a request, you agree to these Terms.

We may update these Terms from time to time. The version in force at the time you place an order applies to that order.

2. The services we provide

We produce practical 3D CAD visuals of home-improvement products, including conservatories, brick extensions, garden buildings, solid roofs and related products. Visuals are produced using professional conservatory design software (PST) based on the specification and information you provide.

Our visuals are produced as a presentation and sales-support tool. They are illustrative representations intended to help your customers visualise a proposed product, and are not engineering drawings, structural calculations, planning documents or building-regulation submissions.

3. CAD Credits

Our services are accessed through a prepaid system of "CAD Credits". CAD Credits are prepaid service credits that entitle you to request CAD visuals from us.

  • One request equals one credit. Each CAD request uses exactly one CAD Credit, regardless of whether the request is simple or complex. We do not apply complexity-based pricing.
  • A "request" means a single visualisation brief for one product or scheme, as reasonably determined by us.
  • CAD Credits have no cash value, cannot be exchanged for money, and may only be redeemed against our services.

4. Pricing & packages

CAD Credits are sold in fixed packages. Our current packages are:

  • 1 CAD Credit — £29.99
  • 3 CAD Credits — £84.99
  • 5 CAD Credits — £139.95
  • 10 CAD Credits — £249.90

The 10-credit package is our largest available package. We do not offer packages larger than 10 credits. If you need further credits, you may purchase an additional package.

Prices are those displayed at the time of purchase. We may change our prices at any time, and any change will apply only to purchases made after the change takes effect; it will not affect credits you have already bought.

5. Payment

Payment for CAD Credits is required in full before any work begins. We do not start work on a request until the relevant credits have been paid for and are available on your account.

Unless stated otherwise, prices are inclusive of any applicable VAT where chargeable. You are responsible for providing accurate billing information.

6. Submitting a request

To redeem a credit, you must submit a complete brief. A request only begins once all the information we reasonably need has been provided. This typically includes dimensions, product choices, finishes, colours and a clear photograph of the relevant property or location.

If a brief is incomplete, we will ask you for the missing information. The request will not be treated as started, and no turnaround time will run, until the brief is complete.

7. Turnaround

Any turnaround time we indicate is an estimate. The turnaround period for a request begins only after both (a) payment has been received and (b) all the information we need to complete the request has been provided.

Delays caused by incomplete briefs, awaited information or requested changes will extend the turnaround accordingly.

8. Revisions & changes

We want you to be happy with your visuals. Reasonable minor revisions to the original brief — for example small adjustments to colours, finishes or framing — are included within the single credit for that request.

A major change to the brief — for example changing the product type, the overall design, the structure or the scope so that it amounts to a substantially different visual — may be treated as a new request and may require a further CAD Credit. We will tell you if we consider a change to be a new request before carrying it out.

9. Credit validity

Unless we state otherwise at the point of purchase, CAD Credits are valid for 90 days from the date of purchase. Credits not redeemed within their validity period will expire and cannot be reinstated, except where the law requires otherwise. Any different validity period will be made clear to you before you buy.

10. Refunds & cancellation

CAD Credits and completed work are non-refundable, except where a right to a refund is required by law (see sections 13 and 14). Because each visual is produced specifically for you, work that has been started or completed cannot be cancelled for a refund once underway, save as required by law.

11. Your responsibilities

You are responsible for providing complete and accurate details for each request, including measurements, specifications and imagery. We rely on the information you supply, and we are not responsible for inaccuracies in a visual that result from incorrect, incomplete or unclear information provided by you.

You confirm that you have the right to use and share any images, plans or materials you provide to us, and that doing so does not infringe any third party's rights.

12. Intellectual property

Once a request has been paid for and delivered, you may use the resulting visual for the purpose of presenting and marketing the relevant product to your own customer. We retain ownership of our underlying methods, templates and software outputs, and may retain copies of work for our records and portfolio unless you ask us in writing not to.

13. Business customers & late payment

Where you deal with us in the course of a business, the following applies. Because work begins only after full payment, accounts are generally settled in advance. Where any sum nevertheless becomes overdue, we reserve the right to charge interest and reasonable recovery costs on overdue invoices in accordance with the Late Payment of Commercial Debts (Interest) Act 1998. We may also suspend services or withhold delivery while any sum remains overdue.

If you are a business customer, you confirm that you have authority to bind the business for which you are acting, and the statutory consumer-cancellation rights in section 14 do not apply to you.

14. Consumer rights

If you are a consumer (an individual buying outside the course of a business), you have legal rights under the Consumer Rights Act 2015, including that our services will be carried out with reasonable care and skill. Nothing in these Terms affects those statutory rights.

Where the Consumer Contracts Regulations 2013 give you a right to cancel a distance contract within 14 days, you may lose that right once you ask us to begin a request and we start work, because our services are bespoke and begin at your request. We will make this clear before you ask us to start.

15. Limitation of liability

Our visuals are illustrative and provided to support your own sales and presentation process. To the fullest extent permitted by law, we are not liable for any loss of profit, loss of business, loss of contracts, or any indirect or consequential loss arising from the use of, or reliance on, our visuals — including any decision made by you or your customer on the basis of a visual.

Our total liability to you in connection with any request shall not exceed the amount you paid for the CAD Credit(s) used for that request.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.

16. Governing law

These Terms and any dispute or claim arising out of or in connection with them are governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales shall have jurisdiction, subject to any non-excludable rights you may have as a consumer.
